Did the Supreme Court rule that DACA was unconstitutional?

Monday, July 13, 2020
By Anna Lenaker
NO

Chief Justice John Roberts, writing the majority opinion in the June 2020 Supreme Court ruling on the Deferred Action for Childhood Arrivals program, did not rule on the constitutionality of the policy. Rather, the ruling focused on whether the Trump Administration had complied with the procedural requirement to “provide a reasoned explanation” for rescinding DACA. Justice Roberts stated that the court's decision did not decide “whether DACA or its rescission are sound policies.”

When Attorney General Jeff Sessions announced in 2017 that DACA would be rescinded, provoking the lawsuit that led to this decision, he called it an unconstitutional exercise of authority by the Obama Administration.

ABOUT THE CONTRIBUTOR
Between 2020 and 2022, under close editorial supervision, Gigafact contracted a group of freelance writers and editors to test the concepts for fact briefs and provide inputs to our software development process. We call this effort Gigafact Foundry. Over the course of these two years, Gigafact Foundry writers published over 1500 fact briefs in response to claims they found online. Their important work forms the basis of Gigafact formats and editorial guidelines, and is available to the public on Gigafact.org. Readers should be aware that while there is still a lot of relevant information to be found, not all fact briefs produced by Gigafact Foundry reflect Gigafact's current methods and standards for fact briefs.
