There is currently no legal mandate that requires companies to ensure their hiring practices match population patterns in the U.S. Charges of hiring discrimination are generally decided based on actual practice and behavior, not overall statistics about representation.

A recent Supreme Court decision extending anti-discrimination provisions to LGBT workers has prompted speculation about how the decision might affect related labor laws and regulations as well as other statutes governing housing, education and other concerns. The Court's opinion alluded to how far-reaching its ruling could be, with Justice Neil Gorsuch stating that "none of these other laws are before us [...] and we do not prejudge any such question today."
